Privacy Policy

PlayUp Interactive OH Inc. (the “Company”) is committed to protecting the privacy of its users. This Privacy Policy (“Policy”) governs the collection, use, and storage of patrons’ confidential information from its (1) Ohio online gaming website, (2) Ohio online mobile gaming applications, and (3) any other online or mobile platform provided by the Company on which betting, gaming, and wagering services are accessed (the “Services”). 

Please read this Policy carefully. This Policy is a legally binding contract between the Company and anyone who accesses or uses any of its Services (“you” or “User”). This Policy is subject to the Company’s Terms and Conditions (“Terms”). Unless otherwise stated, any capitalized terms not defined in the Policy retain the definitions set forth in the Terms. If you do not want the Company to collect, use, or store your information as outlined in Policy, do not use the Services. By using the Services, you consent to the collection and use of your information, including personally identifiable information (“PII”), by the Company.

1. COLLECTION OF USER’S PERSONAL INFORMATION

Personal information, including PII, is collected by the Company as described below. Failure to provide certain personal information that the Company is legally required to collect or otherwise necessary to provide you with the Services will prevent you from using the Services.  

Please note, the Company is not responsible for any information collected by third-party websites, including websites linked to from within the Services. you are responsible for reviewing the privacy policy of any website you link to understand how those websites collect, use, and store your information.   

1.1 Registration Information 

In order to access the Services, you must register for an account with the Company. When you register with the Company, you must provide certain PII, such as your name, date of birth, home address, email address, phone number, and social security number. This information is required to verify the User’s identity, age, and legal ability to access the Services.  

1.2 Account Funding Information 

The Company uses third-party financial service partners to collect payment information such as credit card or bank account information for account funding purposes. This information is processed by the Company’s third-party financial service partners and is subject to the privacy policy of the financial partner you use to fund your account. The Company does not retain this information.   

1.3 Transactional Information 

When you use the Services, the Company collects information about your gaming and transaction activities. This includes, but is not limited to, deposits, withdrawals, wagers, and other information submitted to the Company’s customer service or support teams. The Company may share this information with applicable gaming regulators, local and federal law enforcement, and other government agencies (“Government Entities”) and the Company’s third-party business partners. 

1.4 Location and Device Information 

When you use the services, the Company and its third-party service providers may collect information about your precise physical location, the device used to access the Services, your mobile phone number, Wi-Fi networks, mobile carrier and internet services provider, Internet Protocol address, Media Access Control address, and browser information.  

The Company and its third-party service providers use your location and device information to verify all activity on the Services is performed in compliance with state and federal law. The Company will not sell or share this information except with third-party service providers for physical location verification and Government Entities as necessary to satisfy any legal requirements or requests. The Company retains your location information for at least five (5) years, or as otherwise required by law or regulation.  

You may withdraw your consent to the collection of your location data by notifying the Company in writing or disabling the location services on your device. Please note that you must provide location data to the Company in order to use the Services.  

1.5 Tracking Technology and Use of Cookies 

When you use the Services, the Company may use tracking technologies to collect and analyze information about your activity with the Services and other websites and online services. These technologies include, but are not limited to, log data collected from your browser, tracking pixels, web beacons, cookies, and scripts.  

1.6 Third Parties and Affiliates 

The Company may obtain information about you from its affiliates, affiliated casinos, and services or properties owned, operated, or managed by other gaming licensees, Government Entities, and third-party business and service providers.  

2. USE OF USER’S PERSONAL INFORMATION

The personal information collected by the Company is used for various purposes as described below.  

2.1 Marketing Purposes 

The Company may use the information it collects for internal marketing purposes, which include notifying you of promotions, bonus offers, events, and VIP program information via postal mail, email, push notifications, text message, and other electronic means. If you do not want the Company to use information collected about you for marketing purposes, you may opt out of marketing communications and information sharing as described below in Section 4 of the Policy.    

2.2 Non-Marketing Purposes 

The Company uses the information collected about you for many non-marketing purposes. These purposes include, but are not limited to, verifying your identity, age, and location, monitoring and processing gaming activity and transactions, providing you with updates about the Services or your account, customizing your experience with the Services, satisfying legal or regulatory requirements, protecting the Company against fraud and legal actions, debt collection, and other business purposes as permitted by law.  

2.3 Sharing Collected Information with Third Parties  

The Company may share information collected about you with its affiliates, business partners and service providers, and certain Government Entities. This information may be shared for both marketing and non-marketing purposes, and as required by law or regulation. If you choose to opt out of receiving marketing communications from the Company in accordance with Section 4 of the Policy, your information will only be shared with third parties for non-marketing purposes such as facilitating your use of the Services, assisting you with any customer service inquiries, and satisfying legal or regulatory obligations. 

3. SECURITY AND RETENTION OF USER’S PERSONAL INFORMATION

The Company stores collected personal information on secured servers located in the United States. The Company further protects sensitive information you supply through the use of firewall and Secured Socket Layer encryption technologies. The Company uses industry standard security procedures and requires its affiliates, third-party service providers, and business partners to use reasonable care to protect the privacy of your personal information.  

The Company is not responsible for the security of any devices or communication methods you may use to communicate with the Company. You are responsible for ensuring all methods and devices you use provide adequate security. 

4. OPT OUT OF MARKETING COMMUNICATIONS AND INFORMATION SHARING

If you do not want the Company to use personal information collected about you used for marketing purposes, you may opt out by sending an email stating your request to [email protected], or calling 719-455-2012. You may also opt out of further marketing communications from the Company by following the “unsubscribe” link in any promotional email you receive from the Company.   

5. MODIFICATIONS TO THIS POLICY

The Company reserves the right to modify this Policy at any time. It is your responsibility to review the Policy and any modifications each time you use the Services. The Company will notify you of any material modifications through email or by placing a notice on the Services. You may be required to acknowledge your acceptance of material changes to the Policy in order to continue using the Services. Where acknowledgement is not required, your continued access or use of the Services following modification constitutes your acceptance of the Policy as amended.
